Terms of Service

Plain-language summary: Be honest. Don't abuse the platform. We provide the software as-is and aren't liable for your business decisions or for repair outcomes — that's between the shop and its customer. Disputes are resolved in Florida courts.

1. Acceptance

By using the AutoDiag Pro platform or the AutoDiag Owner App (together, the "Service"), you agree to these Terms of Service. If you don't agree, do not use the Service. The Service is operated by Viktor Pyrkov, Sole Proprietor (d/b/a AutoDiag), 3601 NE 207th Street, Suite 1310, Aventura, FL 33180, USA ("AutoDiag", "we", "us", or "our").

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. Shop accounts must be created by an authorized representative of an established repair business. Owner App accounts may be created by any vehicle owner age 18 or older.

3. Account responsibilities

Keep your password and two-factor codes confidential
You are responsible for all activity under your account
Notify us immediately at hello@autodiag.vip of any unauthorized access
Information you provide (name, business address, EIN, phone, email) must be accurate and current

4. Acceptable use

You agree NOT to use AutoDiag to:

Send unsolicited marketing messages, spam, or content the recipient hasn't opted in to receive
Misrepresent the source, content, or pricing of repair work
Upload content that infringes anyone's intellectual property or privacy rights
Attempt to gain unauthorized access to other shops' or customers' data
Reverse-engineer, decompile, or attempt to extract source code or AI model weights
Use the AI features to produce false diagnoses, falsified inspection results, or fraudulent estimates
Scrape, copy, or resell data extracted from the platform

5. Shop-customer relationship

AutoDiag is a tool that helps repair shops communicate with their customers. We are not a party to any repair work, estimate, invoice, warranty, or service agreement between a shop and its customer. Decisions about whether to authorize, decline, or pay for repair work, and any disputes about the quality of repair work, are between the shop and the customer. AutoDiag is not liable for the shop's diagnostic accuracy, repair quality, pricing, or business practices.

6. AI features — important limitations

AutoDiag includes AI-assisted features (photo analysis, voice transcription, estimate drafting, repair recommendations) powered by third-party large language models. These features:

Are advisory only. They are not a substitute for a licensed technician's professional judgment.
May produce incorrect, incomplete, or misleading results. The shop must verify all AI output before acting on it.
Must not be presented to a customer as a definitive diagnosis without human review.

The shop, not AutoDiag, is responsible for the accuracy and appropriateness of any repair, estimate, or recommendation communicated to a customer — whether AI-assisted or not.

7. Payments

Payment processing is provided by Stripe Inc. AutoDiag does not handle, store, or transmit full payment-card numbers. Refunds, chargebacks, and payment disputes are subject to Stripe's terms and to the shop's own refund policy. AutoDiag is not liable for the shop's failure to deliver promised services or for Stripe processing fees.

8. SMS & email messaging

By providing your phone number or email address, you agree to receive transactional messages from the participating repair shop through AutoDiag, on the terms described in our SMS Consent page. You can opt out of SMS at any time by replying STOP and out of email by clicking unsubscribe.

9. Intellectual property

The AutoDiag platform, software, design, and content (other than user-uploaded data) are the property of AutoDiag and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Your data (repair orders, customer records, photos, etc.) remains yours; you grant us a limited license to host, process, and display it solely to operate the Service for you.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms, abuse the platform, fail to pay subscription fees, or expose us to legal risk. On termination, you may request a data export within 30 days; after that, data may be deleted in accordance with our Privacy Policy.

11. Service availability

We aim for high availability but do not guarantee uninterrupted operation. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, AutoDiag and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total cumulative liability for any claim arising out of these Terms is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $100.

13. Indemnification

You agree to indemnify and hold AutoDiag harmless from any claim arising out of (a) your misuse of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any repair work performed by your shop, regardless of whether AI features were used in connection with it.

14. Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or by notice in the platform at least 30 days before taking effect. Your continued use after the effective date constitutes acceptance.
